These terms apply to your use of this website and to any purchase you make from Emma Hilton. By browsing this site or placing an order, you agree to them. If you do not agree, please do not use the site.

Who we are

This store is operated by Emma Hilton, based in Queensland, Australia. Where these terms say “we”, “us” or “our”, they refer to Emma Hilton.

Using this site

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. You agree not to use the site for any unlawful purpose, not to attempt to gain unauthorised access to it, and not to interfere with its normal operation.

Products and pricing

All prices are shown in Australian dollars and include GST where applicable. We try to describe and price products accurately, but errors can occur. If we discover an error in the price or description of something you have ordered, we will contact you and give you the option to continue at the correct price or cancel for a full refund.

We may change prices, add products, or withdraw products at any time. Availability of any product is not guaranteed.

Digital products and licence

Digital products remain our intellectual property. When you buy one, you receive a personal, non-exclusive, non-transferable licence to use it for your own personal or internal business purposes.

Unless the product listing expressly says otherwise, you may not resell, share, sublicense, redistribute, or make the file publicly available, and you may not sell the file itself or a lightly modified version of it as your own product.

Delivery

Digital products are delivered by download link or email immediately after payment is confirmed. If you do not receive your files, check your spam folder first and then contact us so we can re-issue them.

Payment

Payment is taken at checkout through our payment providers. We do not store your card details. Your order is confirmed once payment has cleared.

Cancellations and refunds

Refunds are handled under our Return and refund policy, which forms part of these terms. Nothing in these terms excludes your rights under the Australian Consumer Law.

Custom and commissioned work

Custom projects are governed by the written proposal or scope of work agreed before the project starts. Where that document conflicts with these terms, the project document takes precedence for that project.

Intellectual property

All content on this site, including text, images, layouts, graphics and downloadable files, belongs to Emma Hilton or is used under licence. You may not copy or reuse it without written permission.

Portfolio and case studies

We may display completed client work in our portfolio and marketing unless you ask us in writing not to.

Third-party services

This site relies on third-party services such as payment processing, hosting and email delivery. We are not responsible for the acts or omissions of those providers, though we choose them carefully.

Liability

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. To the extent permitted by law, our liability for any claim is limited to resupplying the product or refunding the price you paid for it. We are not liable for indirect or consequential loss, including lost profits or lost data.

Privacy

Your personal information is handled in line with our Privacy policy.

Changes to these terms

We may update these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order.

Governing law

These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state.
